How long can we keep interns as part of the organisation in the same capacity ? I know the background to why a company hires interns and what interns are for and when they need to be hired etc.... the issue is I just joined an organisation and it looks like they have interns who have been doing their internship/ projects for 12 to 16 months. Are there any legal concerns/ issues that might arise ? what is the maximum period to have interns work as interns ( i know its not right for they are working).. if so what ? and pointers would be of great help.
Company can have approx.10%of their employees as interns . Internship period is maximum of 6 months after which they have to be the absorbed on the payroll or let go.

There is no legal provision for internship nor any stopping it. There are specific provisions only for apparentice. Under the new NEEM scheme again you can employ trainees for up to 3 years without statutory deduction of PF ESIC
original concept of internship and still being followed in foreign countries is what we call management trainees. It's generally for 12 to 18 months to let the intern learn working of corporate world or to learn specific skills. The terms has been misused by local mba colleges to refer to short term summer internship
Usually at end of internship very few and only exceptional interns would be absorbed. It allows the company to work with qualified but inexperienced people without paying out costly salaries and have the option of identifying the best of them to offer s permanent job

i don't have a copy with me at the moment,
But the HRD ministry should be having it on their website.
Or it will be on NIC.
Google is your friend for that.
The list of approved agents / university under NEEM is at the link below.
