Dear All,
My company deal in Real estate , we hire one employee before 1.5 month. employee running own real estate company along with job , he hide this information to company.As we came to know ,We said him to resign the company , we didn't gave him any termination latter & he resign , Now company are not providing salary of 45 day.
My question is this :-does employee can enroll a case against us and what is the procedure for termination in such case and salary pay out also.

Withholding pay of the employee will not be legally correct.
Did you ask him about any business interests he was having during the interview or during joining processes.
He will say his wife was running the company or family members were running the business.
If he files suit against withholding of pay,then your company may have to pay.

Pay off the dues to the employee and close the matter. You get all types of people. Treat it as a learning lesson and move on.
