It is proposed to add in the draft of Mr. Nathrao the words "and violation of it will be treated to be misconduct." after the word "prohibited" to be more precise in terms of apex court decision in Glaxose Laboraties of 1984 wherein it was held that action can be taken against acts of misconduct and none else. Further in order to make it applicable to workmen, section 9A of ID Act notice has to be given. Furthermore where standing orders are applicable, amendment in the S.O. has to got done as per procedure.
Thanks
Sushil
