BJ Dear All, Under BOCW act kindly clear following things
1) Total cess amount is 1% project cost, so is there any specifications about payment of same, like at the time of sanctioning we have to pay that amount or at specific stage or after completion of project.
2) Registration under BOCW, both principle employer and contractor has to register under act or except principle employer only contractor can take registration under act. If both have taken registration then what will happen.
3) In registration form at no 6 there is sentence that date of commencement and tentative date of completion of project. If projects do not complete before tentative date of completion then what to do with registration form.

The BOCWW Cess is to be paid as per the work completed during the Financial Year. If the project cost is 100 Crores, then in First FY if you complete 25% of work then you will have to pay Rs.25 Lakhs and in next financial year if you complete 75% work then you will have to pay Rs.50 Lakhs and in third financial year on completion of the project, the inspecting officer will visit your project and evaluate the cost of work done and accordingly they will claim for the balance of the amount and you have to make payment.
As per BOCW Act, there is no such Principal Employer. The registration certificate must be obtained by Employer, Contractors, Sub Contractors. The Act does not mention the same clearly. That's the reason the Government Officials are taking undue advantage in this regard.
If you are unable to complete the project within the time limit specified in the Application Form for RC, then you have to apply for amendment in Registration Certificate. (Amendment in RC to be obtained in case of the following changes. 1. Date of Commencement, 2. Date of Completion, 3. Increase in Workmen Strength, 4. Job Scope extension, 5. Change in Board of Director, 6. Change in Manager, 7. Change in Employer)
Further your project's Safety Policy and Emergency plan are to be approved by the BOCW authorities.
