My father was ex-employee of BSNL - took voluntary retirement (currently died/Passed away). He was getting some pension from BSNL. My mother is also retired from Maharashtra state government job and she gets some pension from Maharashtra state.
My Question is
1. Can my mother get my father's pension (after he has passed away) even if she is getting her own pension from Maharashtra State.
2. Is there any rule in which She can not get the pension ?
3. Is it legal to get both pensions ?

Dear Bajirao ji,
According to me, there is no issue if your mother claims dependant pension out of your father's service and also a pension out of her own service.
Two pensions out of two service span by any person are not allowed. In such case, both the service span clubs together and pension is decided, as what I know.
I came across one judgement of Madras HC recently in which two saperate pensions are allowed out of two saperate service span of a person.
