Hi Friend,
i would like to know to take a decision about the below mention case
i am working as a hr executive i have reported to MD here one staff submitted his certificate but its fake (we have xerox copy only) i verified that one, now what can i do for this problem how to handle this please suggest me immediately thank you

First of all let the forum know, which certificate was fake i.e. Birth, Experience, Education, Technical, or others please specify, also let us know whether the staff who has submitted the Fake Certificate is working since how long, so as to ascertain the gravity of the case. In some case I have found candidates use fake Experience Certificate so as to get job, if in case where his/her Experience is not relevant to the profile he/she has applied does not have to necessarily terminate but can give a warning letter if it suffice your management.
Always keep termination of any employee as the last resource.

Dear Sam,
The details provide by you are not sufficient. You must always interact with actual problem. Hiding reasons and asking for remedy in random, it will not appropriate to the experts or contributing mangers to give their advice. One of our friend has given his opinion clearly. In case if you want more interaction with the experts in this thread please come out with fact and seek advice.

Person if he had actually submitted a fake certificate must have done so after understanding the consequences. Basically he is not trustworthy. Management needs to decide whether to retain such persons and if retained whether they wouldn't cause any harm to the company's interest.

How can you conclude it is fake certificate. you said he has submitted only xerox copy. Ask for original for verification. Without verification of original, it can’t be concluded as fake. Pon

Hi Sam,
First of all do you have done background verification from the university of which the employee has submitted the certificate?
Do you have a written proof of his fake certificate?
If yes, then you may ask him to resign, If No, then first send his marksheet/certificate to the university and get it verified.
Please note, keep termination as the last resource, its always better to ask employee to resign.

Ask for originals and verify against the xerox
Send a copy to concerned University to check authenticity of the details
If the documents are found to be false, you can definitely take any action (including dismissal) against the employee. No need to serve notice period to employee in such a scenario
Keep a record of all communication you send to the employee. It is equally important to get signature from an employee on all xerox copies he submits. There is always a risk of, an employee, denying in court that he / she submitted a fake certificate. Without his signature on the xerox, it is not possible to prove that he submitted one
Worse, he / she can even claim that, it was the company management that created this fake doc to trap him / her). Whether this argument would be accepted or not depends, on how advocates from both sides represent their views.

First if you are confident about the submission of fake certificate you may issue memo calling for his explanation and subsequently you have to conduct domestic inquiry appointing enquiry officer duly following all principles of natural justice and the management has to prove during the enquiry that the said employee has submitted fake certificate and got appointment on the basis of fake certificate. finally after issuing show cause notice you may remove him from service.
