Hi All,

I have a total work experience of 7 years. I have recently joined a very renowned company on Jan 9th, 2014. The company procedure is to do background check for all employees and only then, provide an appointment letter.

In brief, here's what has happened - I have completed distance education B.Com from EIILM university, Sikkim (Eastern Institute of learning and mgmt). My current company follows vendor verification (verif vendor name: supersoft consultants). While doing a bvc for me, the verif vendor got a reply from university that it will take 90 days to confirm. My HR came back to me stating we can't wait for so long and please talk to someone from university to expedite it. I have never been to sikkim and was in touch with an institue in Mumbai, from where I gave exams (Premier institute - Primeindia). My institue people did everything to ensure confirmation on mails and telephonic conversation to my company HRs to convince them since my graduation is valid and EIILM university id UGC recognized. Prime India is ready to give any doc stating the same. However, in the meanwhile, one of the existing employees (a person of similar designation to mine) has complained to the HR that my graduation is fake and accused that I had confessed it to him about this, etc.

The HRs called me for a meet and said that we have received a complaint and your university is also not replying, so you can't continue. we are giving you a week's time, you rather leave and rejoin us if the university replies. They interrogated in a very rude manner asking what subjects I have studied, when was the exam, etc. It was a nightmare and very embarrassing. I have requested them to let me be here until university replies.

The institute through whom I appeared for the university have a say that their response should be considered. Whereas, My HR is adamant on getting a reply from university and that too, asap.

Meanwhile, from my side, in order to prove the validity of my certificates, I applied for an MBA at a couple of recognized post graduate institutes like ICFAI, IIBM, etc. I sent them the scanned copies of my all 3 years and asked them if these are valid and can be considered. When I got their positive reply on the mail, I forwarded the same to my company HR. My mail was responded by saying we have got an interim response from the verification vendor, however, we are awaiting a final response and we will let you know if anything is required from you

Now, its been days and seems that the company HR is not bothered to give me an appointment letter nor bothered to ask about doc validity. I am unable to understand if I should search for other jobs or should I wait for the conclusion. I have tried calling the HR lot of times, but in vain. I see them passing by and they give me a very weird look which is very demotivating

Please understand that I hold a managerial designation and job hops are not that easy for me.

Are the company HRs allowed to Interrogate an employee in this manner?

I must say, you have the belly to take this all along and I am at fail to understand that this is happening in Mumbai. I am so concerned now to check the "background" of the HR personnel in concern, if he/she know the meaning of "Education Verification". Sorry, but I am being very critical in my response.

First of all, denial of issuing an appointment letter due to background check delay by company agency, for whatever reason, is a baseless ground to deny the fundamental right of an employee. Infact, an appoint letter must have issued the day the employee was asked by company to join. There can always be a clause that if the education certificate is found to be "Fake", the appointment letter could be deemed cancelled. Besides, I have in my last 20yrs of service first time came across a company denying an appointment letter due to "education certificate" verification issue. I did hear "Experience Certificate" cases, but never "education certificate". In India, we have a very good system to identify a fake and genuine University or their certificates and am at loss how they can behave like "educated illiterates".

My advise:

1. Have a meeting with HR Manager and ask him to issue you your appointment letter immediately and if his subordinate and agency are concerned about the university response;, have a clause include to safe guard their interest.

2. Inform your HR that university verification process will not be done as per their discretion of the company. It will be processed as per University rules, system and process. It may take 90 days or 6 months. Or maybe they will have to re-apply again.

3. The incompetency on the part of HR and the agency of not getting the verification is being very simply being passed on to you, by asking you to go to university and to do their job. Besides mentality and emotionally treating you they way you feel embarrassed. Its so cheap and unacceptable.

Having said that, you being in a managerial position, don't take this unprofessional attitude of the HR individual lightly. Be professional and maintain your dignity without being rude to anybody. We all know at the end of the day we are all doing their job, but not at cost of some else dignity.

PA: Call your university and ask them for "Degree Verification Section". Before calling them, ask the HR to give the u details like "Courier Name and AWB No.", "date of Dispatch", "if payment for verification "DD no", "Bank Name", "Date" and "Agency Name". You don't need to go to University. Usually Call sometime, helps you to get the help.

Dear ,
After read your story, i just dont get why HR members wake up now for verification, Where were during your joining time? It is hr personal's responsibility to check and verify everything before you hire any employee. No need to worry now just continue your work peacefully. In my 7 years career in HR field as Sr.Executive HR, I didnt show such type of case and such type of rude behave.

Actually.. I tried avoiding their looks and concentrated on my job. However, its not easy to ignore without being responded to.
Its like a hanging sword on your desk.. You never know when it will fall? , will it fall sharp on you?, will it go blunt??
Its all fading out without any solution. I tried calling the HR manager, she has a say that her execs have documented that I did not answer adequately/correctly about my education when interrogated. She's also kept things on hold until university replies :-(

OK FINE, U GIVE ME MY FEW QUE'S ANS THEN I WILL U SOLUTION IN LEGAL WAY...
WHAT DOCUMENT THEY GIVE U TO JOIN...I MEAN ANY OFFER LETTER OR ANYTHING ELSE???
Are they provide you any paper or identity card thru which you can prove u are employee of this org??
On what basis you accept their letter to join??

Yes. Before joining, the gave the letter of intent.. And then, icard n access card too.. But ot appointment letter

Dear Ukmitra,
I had a word with the HR manager and as mentioned in my previous post, things are documented against me stating I did not provide relevant/sufficient answers about my education related questions asked by the HRs. She's waiting until the university replies on it
Also note that, I researched on the EIILM university website and have mailed them requesting to reply asap describing the current situation on their info and support IDs, have got only an auto response stating it will take 4 weeks time for the mail to be responded to. I had kept read receipts on all the mails and so, can ensure that all of them were atleast read , and thereby replied with an auto-response
Meanwhile, I have also registered a complaint against the university stating the non responsiveness that's costing my career insecurity in the consumer complaint forum

The response from HR Manager is "laughable". How can some give "irrelevant/insufficient information" and they the Company issues your an offer letter and ask you to join. Are they insane or what. You know what....I am getting so irritated by this "Character in your office" :((.
Don't send e-mail. Call the university and get someone to talk to you. E-mails does not work in our universities in India, neither does "Grievance Cell". So, don't waste your time here. In the meantime, put down your request in e-mail to manager. Verbal discussion, does not hold good later for supporting your claims, if they dismiss you.
Anyways, if you must hold the Job, you have no option but to keep giving those "Highly educate HR personnel very high HOPES" that you are getting the verification and keep buying time from them.
Verification report will take time, but you will get it. Wish you good luck.

U do one thing firstly try to convince ur HOD or HR head and inform them, I have working for last 7 yrs and i have not done any fraud during my tenure related to work or my certificated so i need time to prove my edu certy so give me some time. I never done any fraud with this org also.
After all this, if they will not convey, write any simple application and submit to labour officer. This is last option to save job and reputation. No need to worry, u r in strong position now, before submit this application once mail me so that if required any correction, i can guide u. Best of luck.
