As per my opinion he can not do like that.The equal remuneration act strictly prohibits such kind of malpractices.
Normally bonus will be calculated on total gross earned in the last financial year and it will be multiplied by the bonus percentage, it may be 8.33 % or beyond of that. So just in a view it can not be identified whether an employee is given given less bonus or more compared to other same graded employee. Cos that difference may be due to number of days he was worked in the last financial year. And one more thing is as per the statutory obligations one must be given minimum of 8.33 % of bonus. whatever the excess of this is called Ex-Gratia. When comes to Ex-Gratia the equal remuneration act doesn't apply here as it will be the extra sum given to higher performance.
This is my understanding, please let our seniors to share their opinions and clarifies this.

I am having one query regarding PF the company is covered from 01-08-2007 with 21 employees we have made contribution for 4 to 5 employees as rest were drawing above 6500 and from 01-04-2008 company started deducting PF for all employees as per limit of PF ie contribution Rs.780/- now the coverage as gone back period the question is that we have to pay for 4 to 5 employees of whom we had paid at time of coverage from back period or for all employees
