If completed one year then employer pay to employee one year notice pay in lieu of notice, if not completed one year then no issue to pay the same
In opposite if employee give resignation after completion of one year service employee will pay one month notice pay in lieu of notice or non completed of one year service he is not liable to pay the same please clarify

Dear Sir,
On a Project of a company,
I completed 2 year service. I hadn't receive any appointment letter. But Company paid to me following benefit on releasing time to me :-1. Two years retrenchment benefit i.e. 15 * 2 * Daily Basic Rate, 2. One Month Notice Pay i.e. 26 * Daily Basic Rate.
On a other Project I have join,
No appointment letter issued to me. Date of Joining is 1.2.2013. now I would like to resign. Will the company deduct one month notice pay from my salary?

Dear Asit, Greetings!!! They may deduct your one month salary But since there is no offer letter, they may not deduct either. That varies from company to company.

Dear Asit,
When an employee join an organization, the company provides an offer letter / appointment letter or both to its employees. In that letter, the employer mention the service obligations of both sides, which is accepted by the employee by signing a copy of that.
As in your case, you have mentioned that your employer didn't give you any appointment letter then it means there are no obligation towards both side. If you leaves the company, they may not give you anything and you can also not ask them for the same as their is no written statement for that. In the same way, you are also not liable to give the notice period or notice pay. And, they can also not deduct from the salary. If they do, you can ask them that there is no such service condition and if still they do, you can lodge complain against them.

Dear friends
I am from a company in advertising sector.i had joined this organization in jan 2012.
I have resigned from this organization on 23 Nov 2012.
My appointment letter states that i need to provide i month notice period or payment in lieu of the same.
My probabtion period was for six months. i am permanent employee now
i am offering them my november months salary to buy out my notice period.Is it ok to do the same.
Help will be appreciated

Dear Friend,
As mentioned in your query that you resigned w.e.f. 23-11-2013, which means that you have salary of 23 days with them. Whereas as per your appointment letter, you will have to provide 1 month (30 days) notice or salary in lieu of it.
So, might be possible that they will ask to serve 7 more days or salary in lieu of it.
