One of our employee who is expecting her baby in 1st week of Oct'13 is advised by her doctor to take rest (leave) from Jul'13 itself keeping her health condition in consideration.
My query is from which month shall she be eligible for paid leave of Maternity Leave - from Jul13 to Sep'13 OR Oct-Dec'13.

As per payment of Maternity Benefits the employee is eligible 6weeks pre delivery & 6weeks post delivery. For other period you shall adjust any leaves available or you shall consider it as LOP.

Considering the date of delivery of employee as October 1, 2013 she will be entitled to maternity leave from around August 20, 2013.
Any leave prior to that can be considered as per the company policy, available leaves etc.

As you have mentioned that the employee is advised to take rest (leave) effective July, which would anyway result is LOP, considering the period of 3 months between July and September. Therefore calculate the leaves accordingly, however would suggest you to consider the Maternity leave as per the statutory law. As what if you pay salary to the employee for the initial period and then give her an extended leave by the month of October, and if the employee resigns due cos of any complications.
