Need your help, suppose employee who does not falls under ESIC, goes on maternity leave, kindly let me know the procedure of Maternity payment/salary, do company has to pay for 3months. As per factory act.

Dear suresh Woman worker shall be entitled for maternity benefit ,if she has worked for 80 days or more during preceding 12 months , otherwise not responsible for employer

If the woman employee is not covered by ESIC, she can claim matrnity benefit under the Maternity benfit Act 1961 for 12 weeks, provided she has put in minmum80 days of sevcie in the 12 months preceding the expected date of delivery.
