hi,
am chaithra working as an HR for a private company.
Recently one of the employee went on maternity leave. she was give paid maternity leave for 3 months as per the maternity act. now she don't wants to resume to work because of some personal problem.
pls suggest me whether she is eligible for the final settlement. also let me know whether we need to deduct her 3 months salary paid during her paid maternity leave in her final settlement.

Hi Chaitra
As per the Maternity Benefit act every female employee is eligible for 3 months. There is no any provision for adjust the paid amount in their final settlement.
I feel it is better to clear the F&F. If she is not giving any notice period that shall be deducted for max of 30 Days.
