Dear Senior, If an organization has an exemption in the EDLI scheme but without a certificate for the same. As per the requirement by RPFC, the organization has already submitted all required documents to RPFC & CPFC for taking exemption(certificate) hard copy as per provision of EDLI Scheme,1976 Under sec17(2A) of EPF&MP act, 1952 but RPFC & CPFC didn’t issue the EDLI exemption certificate to the employer. when the organization had stopped the contribution (0.5%) in AC-21 (EDLI) without getting exemption certificate & submit the same contribution to LIC as a premium from last five years against EDLI exemption but without getting EDLI exemption certificate from RPFC & CPFC, what Step be taken for an employer in this condition.
Kindly suggest what we can do for getting the same & if it is non-compliances then what penalty to be imposed for an employer in this case while employer already submit all required documents & stopped the contribution in A/C 21 in PF challan without getting exemption certificate.
Please suggest & advise for the same ASAP.

You are advised to write a letter to the RPFC and CPFC immediately, giving the facts that you have made an application for the said exemption and accordingly you have stopped the contribution in A/c.21 and A/c. No.22 with EPFO and started paying to LIC scheme since last 5 years.
Please note that if you do not get a refusal letter to your application submitted with in stipulated time / reasonable time, the application shall be deemed to have been granted.
You are required to pay inspection charges at the rate of 0.005% of the basic wages and dearness allowance, subject to a minimum of Re.1 per month and submit a monthly return to the RPFC.

This is also bring to your kind notice that ,we are deposit the amount in PF challan on A/C 22 at the rate .01% regularly without break initially . Please suggest in which account of PF challan, we should pay inspection charges .005% & also please advice ,we are not submitting the EDLI return From 7 (IF) from last 5 years from when we stooped contribution in A/C 21 & deposit the premium to LIC for EDLI scheme. Now ,can I submit the EDLI monthly return from 7(IF) to RPFC .

The EE amount is Employee's share which was contributed by you. and Employer's contribution divided into 2 parts PF and PENSION. The ER amount is only a PF amount contributed by your company and Pension amount is EE-ER. So 83627-29158=54469.
All to that simply we can say that you will double on your EE amount i.e 167254 (if your contribution period less than 10 years)

You need to pay inspection charges by generating challan online. Login to EPFO Employer E-Sewa. Go to challan entry in Challan menu. Select month and then click on cont / admn / insp challan. Then enter the amount of inspection charges in respective field.
It seems to me, you need to generate the challan month wise. There is no provision for arrears.
But I feel you can try to enter the total amount of inspection charges out standing in your account till month on selection of the month in which you are making the payment. Write down by hand the period and make the remittance in SBI.

Thanks for your reply ,I have already prepared Jan.13 month challan dated 13/02/13. I have regularly process online PF challan from April.12 & I have submitted the amount in A/c 22=0.01% on wages month wise w.e.f April.12.As per your advice , I will try to enter inspection charges at time processing Feb month challan .
But as recent information by cite hr member ,EPF office sent exemption order they clearly mention on that letter stated employer is liable to pay 0.01% or minimum 1 Rs. company will pay as a inspection charges in A/c 22 .is it true .
If it is true ,I have already pay 0.01% in A/c-22 regularly every month . In this
Condition it is mandatory to pay the same in Challan or not .
