Dear Sir I am confused about the payement of EL/PL leaves at the time of full and final. I want to know should we calculate the EL of the employee earned to be paid in next year in full and final settlement. For example in Oct 2012, an employee have 20 EL in his account (these 13 EL has been credited in Jan 2012 in lieu of work performed last year i.e, 2011)Now in full and final settlement we should for for 13 EL only or we should calculate the day worked during 2012 by him also and than add the earned EL in 13 and pay to him. I hope you understood my problem. i will appreciate if answered with some evidence and reference with law/section.

The EL's have to be calculated upto the day(month) of his leaving and encash the same
mentioning it in F& F settlement.
Suppose an employee leaves the job on 1st.June the leaves for 5 months has to be
calculated and put in his F & F settlement .

Mr Rajeevs explanation is correct and the employee has to be encashed leave for the days he earns leave for the current year upto the day of his leaving service
