No, you cannot take the withdrawal benefit under sec.14 of the EPS, 1995.
There is no provision under section 14 to deduct the NCP from the length of service period.
Moreover, there is no provision to reduce the NCP in “Actual Service” as per section 2(1)(ii).
NCP is to be effective only for calculation of Pensionable Service under section 2(1)(xv).

than if member join in 01/01/2002 to 31/01/2012 for just only one month & then after he join 01/01/2012 to 31/01/2012 with same epf account no. in same establishment ... then he eligible for member pension.......???

Dear Chirag
As to your Initial post the answer is that you can not withdraw the amount.
As to your second post kindly clarify as to how the employee will be given the same EPF number after 10 years as his date of leaving would have been intimated in 2002 and therefore the account is closed to contribution or do you want to say that the employee was on leave for 10 years without pay ?

member get same pf/fpf account number if he not withdraw pf/fpf amount & if he join same establishment .yes member migration to india for 10 years & then after he rejoin the same establishment

I am not getting your point of query. Please clarify. Also please check the date mention in your second query.
However, there is difference in NCP and break in service.
Under the EPS, 95 for considering the actual service period the NCP to be considered for the purposes of withdrawal benefits. If total period of actual service is 10 years or more, as per your first query, Member will not be eligible for withdrawal benefits.

Dear CHIRAG
Don’t confuse yourself. NCP to be considered while calculating the actual period of service and not to be deducted from the length of service period even if there is some period in which there is no contribution (NCP). Hope you will get the point.
