Dear All ,
I have a query regarding experience letter . I worked in a company as Trainee for 14 month in 2006 ,and left the organisation after verbale communication with manager . Now I requested company HR to provide me exp letter for my trainee period there but HR has denied to provide me expiernce crtificate for the same stating that you are absonding from the company.
I requested them if there is any due ,you can recover from me but HR department has denied to do any settalment in this case .
I would like to add few point here these are : I did not get any letter from company regarding my joining as trainee. I only got my Bank acount opened by company to get stipend .Neither Company sent me any warning letter/communication regarding my absence ,And now they are saying that you had been absconded from company.
Please suggest the ways ,to get the expierence letter from organisation .

Dear Prakash
Whenever you are having any dealing with your company you must have it in writing. Immediately you submit an application to your company stating that you have worked from ------ to ------ and after taking verbal permission from your superior you have left the job and due to your ignorance (please note that ignorance is not an excuse) you are not submitted the written resignation. Due to that verbal resignation you have not received any letter regarding your absence. Now, you want to have an experience certificate. You can state that you are ready to come and do the clearance from your office and dues if any, also will be paid by you. If you submit an application, it will be an evidence that you have asked for the experience certificate.

Dear Prakash,
Can you pl mention that as a Trainee were On roll or Off roll employee. If you joined as an Off roll employee you are not entitled to receive the letter from company but from the consultant on who's roll you were. Assuming you were an On roll employee, why didn't you ask for Joining / Appointment letter within 14 months. Even at the time of resigning, instead of consulting with HR, you just spoke with your manager & left. Did you serve the notice?? was the manager aware about your JOINING TERMS?? If yes, you can take him in loop & request the HR as suggested above by Mr. Bhaskar.

I was trainee and were getting stipend directly from company.And that time company were not providing any appointment letter to trainee staff . Appointment letter were only to be provided to the person who gets regularised by the company . And I left organisation coz my manager was not intersted to regularised me and same time got good oppurtunity outside .
As i have not signed any bond or didn't get any letter which states that I should provide 15 days or 30 days NP .
I need this company exp .letter as my current organisation require evry companiese exp letter .
I am ready to pay all due to company but still they are not interested and denied to provide me exp certificate.

Hi,
If as a trainee you were not eligible for appointment letter then for sure you are not eligible for experience letter. You can request to provide them STIPENDIARY TRAINING LETTER which mentions the tenure & the kind of training you took from your company. Seems company is adamant on not providing you anything. Why don't you ask your company that was serving notice the only reason for holding back the letter or is there something else they expect..

Dear Hiral /Bhaskar ,
I contacted my HR, they told me ,As I have not served NP and hence your separation is not clear ,So they can't provide me experience latter .
I reuested them that if there is any way I can get it ,even if company want to recover some amout against my relieving ,they can recover from me .
Unfortunatly HR told me that thier company policy does not allow this kind of settalment .
I will be thankfull to you if you can suggest/educate me about Company/Employee Law on these kind of issue .
Is there any Law in constitution which help employee on these kind of matter.

As far as I know, these are company policies & has nothing to do with Law. Experience letter & notice period differs from company to company. The only option I see is request you immediate reporting boss & HR together if they can convince the management.
