Shoba Ji, Minimum 20 employees required for ESI / PF Coverage but if your company is dealing with Power then 10 is the minimum limit. Chill HR !!

Hi shoba,
There was an amendment in ESIC on 16-03-2011 applicability of the Act to an Organization is 10 or more employees for going registration, no mater of using power.
For PF registration minimum 20 employees to be there in your establishment on any day of the preceding year.

If you employ 20 or more persons you will be under EPF Act.If yours is a factory and employ 10 or more persons ESI is applicable.If it is shop or commercial establishment ESI will be applied if it employ 20 or more persons.Some state has reduced this no to 10.Pi confirm with your nearest Branch office of ESI.The persons referred above need not be within the salary limit.

Thanks for your time in replying.
I still have a question, Bonus rates being anything between 8.33% - 20%, how is that Rs.3500 is considered as a standard amount for earnings from Rs.3,500 to Rs.10,000? For example, if the salary is Rs.3500, will he get an equal amount of Rs.3500 as bonus?
And what about salaries beyond Rs.10,000?What is the bonus on this?

Dear Sobha & All,
it's 10 employees for ESI for all from June 2010 as per attached notice from ESI and 20 employees for PF but if you have less then 20 employees then you can apply for voluntary PF.

Dear shoba,
The bonus is depends up the basic + da if applicable only , if you are covered under compulsory bonus act, then bonus should be provided minimum 8.33 % from whatever the basic amount even loss is occurred to company in the previous year .
( maximum bonus can be given up to 20 % )
ESI - is applicable to all employee those basic is not more than 10000.

Can anybody guide me that
1) I am working in a pharmaceuticals for marketing of medicines. This company earlier providing esi facility to every emlpoyee. But some how the company sold out to another person and now new management has said that ESIC is not applicable and we will not provide for employee. Can I ask for legal platform? How? Can employer will be punished? ( Because older employer was giving this facility, now this company's name is under the list of defaulters on ESIC's web site.)
