Respected Seniors ,
It-Company is comes under the Shops and Establishment Act , employees of company goes outside the company for any company's work related and there is no ESIc of any employee also .
and in the way if any employee get accident so who is responsible for his expenses , what is employees benefit under this act .

Dear Bhavya,
When an employee is going for any company related work & met with an accident then the company has to pay the medical expenses if the employee is not covered under ESIC or mediclaim policy / GPA policy.
Normally in IT companies most of the employees salary will be more than 15000 so they will be covered under mediclaim policy. For employees less than 15000 they will be covered under ESIC. The company also takes Group accident policy for employees in case of death or disablement benefit.

In such case normally the salary for number of days the employee is not able to attend the office after accident is generally paid irrespective of his leave balance, in other words such employee is considered to be present till he is able to resume his duties physically. But the medical expenses depends on the mediclaim policy which the company has for the employees.

Very simple. Employees are entitled for benefits under Employees Compensation Act. As per the provisions of the Act, accident victim is entitled for 50% of wages, full cost of treatment and if there is any residual permanent disability, due compensation.Pl.refer the provisions of the Act.Normally, Companies buy policy for EC Act and if so, it is the responsibility of the Insurance company to pay the benefits.Pl.check if yr company has bought any policy and the name of the concerned employee appear in the list of the policy document

Dear Bhavya,
As a preferred employer of choice by employees there are some basic expenses that company need to look at. One such case would be employees medical benefit whoever is out of the purview of ESIC. You can recomend for mediclaim and GPA policies for such employees.
Any employee meeting with accident while on duty even if it is outside the company will be considered as "accident during the course of employment" and employer has to take care of his/her medical expenses, unless the employee is under the influence of alcohol.

In case company's employee strength are less then 15 , so it is not comes under Esic and also company has no any policy like accident or Group insurance .
And if thare is any employee get accident then it is same applicable the your suggestion sir ?
