The ESI Maternity leave will be granted to the employee by the concerned ESI Dispensary/Hospital wherein the consulting doctor will clearly write on the information of sickness sheet as she is under medical treatment and needs rest . The same sheet will be submitted by the employee to the concerned HR. The period of absence is being written in it.

If the 5yrs service finished female employee was covered under ESI previously and now she gets more than 15K per month and she wants Maternity Leave means who is liable to pay for that 84 days of ML? or she is eligible or not?

If the female employee having been an IP is now outside the purview of ESI will be eligible for Maternity Benefit from the employer if she is not eligible for it under ESI rules.
