Is FORM - D (Equal Remuneration Act 1976) applicable for a company, where the employees are less than 10 in a Company

We have been registered under Shops & Establishments but am doubtful that Form D is applicable or not? as we have not maintained. If so, the form is available readily, but after filling the form, who should sign on that or do we need to go and submit it in labour office?
