Kindly note that our contractor has deployed around 200 daily workers in the project site on rotation basis. I want to know that how should we maintain the statutory compliance check for the contractor:

Dear Rajib,
To start with dont encourage the contractor to work without the labour lics of adequate head count.Now,as the principal employer you must have the registration done with the labour deppt for engaging contract labour only upon which you can you can employ contract labour. In case its done,hand over the Form V to your contractor and intimate him to apply for the labour lisc from the local labor office which shall be exclusive for your premises.you have to maintain the data of the contractor and the contract labour you engage and deploy.
As per the scheduled employment at which these contract labour are deployed at your site,collect the latest "Minimum Wages" notification from the labour deppt from time to time.Now as per the provision of minimum wages the gross salary that your contractor is paying to the labour on its roll has to be equal to the amount of minimum wages applicable for that period of the year.You can ask your contractor to submit the copy of Wage Book (Wage register),that every contractor has to maintain,with details of wage paid to the labour and countersigned by them.Make it a compulsory practice for the contractor to provide wage slip to the labours they deploy. Ensure that you ask your contractor to submit the "Minimum Wages return" annually.
Ensure that the contractor issue employment card & temp esic card to the labour within 3 days from the date of deployment and you can ask the contractor to submit a copy of the same to you.You can make it a mandatory practice for the contractor to submit to you the copy of challan for PF & ESIC payment for the previous month and a deceleration from the contractor with per head break ups of the total amount submitted for the month,name of the employee,their PF & ESIC numbers along with the bill for the current month.It should be made compulsory for the contractor to provide you the copies of Half yearly return of ESIC and Annual return of PF
Copies of registration,notices and abstract of the applicable enactments should also be displayed at the site.
