Dear All,
Please help me out. If there is no leave policy in the firm and in near future will implement the policy depending upon the management discretion. But the leave is deducted if there is any leave taken by the staff after completing even the probation period of 6 months. But sometimes the genuine reasons are considered and salary is not deducted. But i want to know is it necessary to have the leave policy though employer is in any business or is it completely under the management discretion.

Dear Ms. Shraddha,
Are you covered under Bombay Shop & Establishment Act then you have to give minimum 21 leaves per annum
If you covered under Factories Act then for every 20 actual working you have give 01 day Earned Leave

Dear Sir,
The firm i am working is covered under Companies Act 1956. So i know that there is no particular leave policy covered under this act and i know how to frame the leave policy. But my question is i want to know is it mandatory to have the leave policy though employer is in any business or is it completely under the management discretion?
