A person joins an educational institution as a full time teacher at the age of 60 years. Whether he is eligible for gratuity after he completes five years of continuous service. I feel he is eligible....request the honorable members to please respond.

Why not. Gratuity Act does not bar employees who are of the age 60 years from recieving gartuity. B.Saikumar HR & labour Law advisor Mumbai

Dear Raj,
Gratuity is paid out at the time of superannuation (if you retire at the age of 58 ), when you retire (at any other age) or resignation, and in the event of your death or being rendered disable because of an accident or illness. You need to have at least five full years of service with an employer to qualify for gratuity.

Dear HR Colleagues,
I just handling 1 company in Dubai and need your advice on the calculation of unlimited employment termination bellow:
example :
S join company A since 17 Dec 2006 then will terminate on 19 Mar 2012 inclusive of 30 days notice period. S basic salary AED 11,000 & accommodation allowance AED 12,000, S still have unused leave 10 days of 2011 and in the employment contract stated S entitled for incentive 25% of the gross salary.
Questions:
1. Formula calculation of End of service gratuity
2. Formula calculation of Unused leave
3. Formula calculation of Repatriation expenses
4. Formula calculation in lieu of the notice period
5. Formula calculation other component of termination (if any)
Please give me an immidiately advice.

Dear Sir, Yes he is eligible for gratuity. There is no restriction of Age. After of completion of 5 years at any stage beyond 60 years also, he is eligible for gratuity. D.Gurumurthy HR/IR Consultant
