I have joined a new company as a Sr.HR Executive. Before joining they told me that on the day of joining I will get a offer letter and after completion of probation they would give me an appointment letter. Now I have come to know that there is nothing like an appointment letter but they just give a confirmation letter. The company is ISO certified. They informed me that they will give me all company benefits like PF,Bonus,21 Paid Leaves after I am confirmed.I would like to know that is this OK or is there any risk. Is my job insecured?

It is kind of weird. In many companies they first give Offer Letter and on the day of joining they give Letter of Appointment. There are some other companies that do not issues any Offer Letter but gives Letter of Appointment before or on the day of joining to its employees. No company defers the release of Appointment Letter till the completion of Probation Period. On completion of probation, employees are given “Letter of Confirmation”. All monetary benefits, such as PF, ESI, Gratuity, etc are given from the day of joining and not after the completion of Probation period.

In case there are not too many days to get the appointment letter/mail. You may wait.
Otherwise, you can talk with your company HR and simultaneously look out for a change.

I opine that the begining should be with somebody somewhere hence being a HR Sr.Executive you should communicate very professionally and politely regarding the risk behind the wrong practices. There may be some professional & intillegent people in every organization, identify and accordingly implement.
As told by some of our friends the offer letter is to be issued on selection basing on which the candidate submits his / her resignation and maximum with in a weeks' time the appointment letter should be given. The confirmation letter is after successful completion of probation. The ESI, PF, PT etc etc., are to be implemented from day one of the joining of employee and it is to be extended to even contract or casual worker also. If the company continues the present scenario they have to pay huge penalty for noncompliance hence appraise them the consequences, if the work culture, atmosphere and all ok continue or else try and switch over to other job.
I strongly feel that some one has to bell the cat why not you.

Hi, I can suggest you to be polite and try to dig the details about the company simulteneously look out for a change. as per my knowledge no company will say thay they will issue the appointment letter after your probabtion. Or else, if you have the rule in your hand try to change this policy. You will be idetified as one and employees may appreciate it.

There are plenty of employers who do not fulfill social compliances (labour laws).
in fact certain sectors are notorious eg garment export..
To answer what swetha has said regarding the presence of a company policy of giving appointment letters after completion of probation period,
a company policy cannot be subservient to the law.
downside of putting your foot down and asking for the letter - you may have to leave else bow down..
employer/owners wont change overnight.

Same problem is in my firm as mandy had told my company is working in field of agri-horti field since 1983 bt they never issue any appointment to anyone except some senior and there is no HR in our office. Accounts person deals with these things.
and this is work culture here no one raises voice, if they then now they are giving appointment letter on that condition you have to work in this company for 3 years and never work in same profile organization and if you have to pay a huge amount 2 lakhs around is this right. please guide me.

I joined this company 10 days ago and the culture of the company is OK. There is a lot of attrition in this company. Because of attrition the recruitment goes on and on. I feel because of high attrition they may not be issuing an appointment letter. It is a growing company and I personally feel if they want to earn a good name in the market they have to follow all the HR process properly.

If the management genuinely wants to improve you may reach the reasons behind attrition by implementing the best in class practise-
The Exit interviews should be conducted by reputed 3rd party player pref NGO, 3-4 months after exit, another condition is employee must be firmly settled in new job. then also treat the employees with the same respect due to a customer. they may or may not choose to answer, this is where a NGO will do the purpose.
