I need guideline’s relating PF because I don’t have any prior experience,
I am working as HR – Executive over here. In our company I don’t have any senior who can get clarified these issues.
1) How we will get to know the changes in PF calculation or any changes in labor department (minimum wage, remittance of labor welfare fund)
2) When can an employee withdraw his PF amount? After his resignation does he need to wait for 2 months from the date of leaving? Where we need to submit those forms in PF office can we use soft copy for withdrawal?
3) When can employee get back his claims from PF office?

Please find the answer for your above questions.
1. PF is 12% contribution from both side,( employer & employee) incase there are changes ( minimum wage or any other change) we need to get intouch with the local labour office. ( most of the companies outsource to vendors who will co-ordinate for all statutory compliance)
2. Employee can withdraw the amount after his resignation, yes he needs to wait for 2 months from date of leaving to apply for it. not sure if sofy copies will be accepted.
3. 3 months for the time of applying.

For the first year you have to keep in touch with the respective department. From Second year you will get the letter from Labour Welfare Board, Professional Tax (Corporation), ESIC - you can view all the updates in your ESIC portal login, PF/ESI is a statutory calculation which does not changes unless there is an amendment. Minimum wages can be collected from LWB / Labour office.
2) When can an employee withdraw his PF amount? After his resignation does he need to wait for 2 months from the date of leaving? Where we need to submit those forms in PF office can we use soft copy for withdrawal?
After 2 months from the date of leaving he can apply the PF withdrawal form. you can use the soft copies downloaded from EPFO site or respective EPFO site.
3) When can employee get back his claims from PF office?
It depend on the state. in some state you can get your money by 40 - 45 days.some state it takes more than 3 months. Today EPFO has given the employee to track his claim status and also he /She can know his balance in the PF account.

Do the company need to submit the PF withdrawal form to PF office or employee only submit the form after 2months of date of leaving service to PF office. Can you refer me any website where I can get more information regarding changes in any law relating to HR field. I want to learn new aspects in HR.

No, you can only submit only 1 cheque. in PF challan you can only fill 1 cheque details.
or Pls visit the SBI bank where PF contribution is remitted in person and hand over the same to the concerned person. The 2 cheque amount should tally with your contribution. Pls explain them. Don't put in the drop box.
But to avoid unnecessary problems in future don't issue 2 cheques.

I would advice you to encourage employees for EPF transfer rather withdrawal because this small contribution may act as big security during bad times and old age. Please go through the benefits of EPF to be avail by the employees.
APPLICATION FOR TRANSFER OF EPF ACCOUNT (Form-13)
(1)To be submitted by the member to the present employer for onward transmission to the Commissioner, EPF by whom the transfer is to be effected.
(2) In case the P.F. transfer is due from the P.F. Trust of an exempted establishment, the
Application should be sent direct by the employer to the P. F. Trust of the exempted
Establishment. With a copy to the RPFC concerned for details of the Family Pension
Membership.

Dear seniors
i worked in raipur branch our hr people are given the pay sheet in the salary slip showing pf amount like that three months deducted after three months our hr people are given cheque total amount. actually we don't know what is the cheque but we taken into our account after that we know that is our pf account after that same in hyderabad pf account continuation, i lost three months service in hyderabad pf account after that we came out the organization, and they gave the service certificate (entire years including pf breakup) now can i give the complaint to raipur pf office and hyderabad pf office please give an advise.

From the details you provided it is presumed that you would have signed some papers (which purportedly your claim settlement/resignation forms) which they processed and in settlement thereof they paid you by cheque. It appears you ("we" means many of you ?)-"came out of office" after this incident "duly resigned". If so, it appears your office would have never opened PF A/c and whatever they deducted from you, either in part or in full, repaid you as settlement. In all probablity they closed your PF A/c. What action in store for you would depend on what are all documents with your employer. still you can try by lodging a formal complaint for not opening PF A/c. and not depositing the PF deductions with EPFO.
Did they give you your PF A/c. No. and statement of A/cs of your PF A/c. ? Pl. find out full details and act accordingly.
