I was joined in a pvt ltd company on 01/06/2011 after getting an offer letter on which only the 'POST' and date of joining was mentioned. Still, I didn't receive my APPOINTMENT LETTER. I received a mail yesterday which is TERMINATION LETTER about that I was in total dark. My question is whether the company can issue me a TERMINATION LETTER before issuing an APPOINTMENT LETTER?

Hi Ssubrata,
As per your post it is just 14 days since you joined this company and you have been given a Termination letter...
What is the reason of termination letter? can you please clearly state that, if you are not aware of that i'm sure it would be mentioned in the letter.
Also, I'm surprised that you are not at all awed by termination letter (it looks as if you were expecting it). Have you forged some documents, or misrepresented some facts and figures, what is it that in 15 days company is terminating you...If you want to seek genuine guidance from us here, please mention the truth in detail.
Please check in your offer letter if any clause of termination of employment is mentioned or not,and then talk to someone in HR department and clarify your issues about termination.

I totally agree with Archna.
Barring some really unfortunate circumstance which may have befallen your employer since your offer letter, hardly any employer will even want to go through the whole recruitment process twice in a month - for the same position!
And yes, your post doesn't appear as if you were surprised at getting it. Like Archna said, you sound as if you were expecting it. And, now, the crux of your question is - can a termination letter be issued prior to an appointment letter? In essence, you are seeking information on the technicality and mechanics as opposed to being shell-shocked at being fired within 15 days!
And, just in case, you're really innocent, then my suggestion is to detail the truth as Archna requests you to.
Else, I think your new best friend should be your lawyer!
Kind regards,

Hello ssubrata.sarkar,
I second Archna & Gaurav Sareen.
To reply your query:'whether the company can issue me TERMINATION LETTER before issuing APPOINTMENT LETTER?'--MAYBE they didn't think it was worth it to issue you the Appointment Letter?
Also, pl remember that they did issue the Offer Letter.......so they are within their rights to issue the Termination Letter.
Now UNLESS YOU GIVE THE TRUE FACTUAL PICTURE of what happened [which is DIFFERENT from what you 'THINK' happened], I don't think anything worthwhile can be suggested by this Forum.

Thanks everyone for valuable suggestion.I just want to describe the total picture. The offer letter which I rcvd and accepted only my post and joinnig date was mentioned. For your kind information there are no question
of forgery or anything. The company is pvt.Ltd. co. and have its H.O. at Delhi. There is no office at Kolkata and only one representative of co.(Besiness Devlopment Executive) is using distributor's office. I was asked to report to B D E.But the respective representative told me any financial matter you have to talk directly to the M.D.of the co. by whom I was interviewed at Kolkata and was selected. The most shoking was when I asked the B.D.E on my joinning day what is our salary date the person couldn't tell the date, also said the date vary and for that I can't do anything you should talk to M.D directly! I started work but I realise I have to quit the co as soon as possible and startrd to find the new job. After two to three days later I requested to B.D.E for my tour advance
as it was sales job and the person said "I already sent the mail to H.O for your tour advance ,you just send your Bank A/C. no".I sent the mail to
accounts department as B.D.E told me but two days after accounts department told me it require permission of M.D and also told me to send mail by B.D.E to M.D and we will credit it in your account.Immediately I informed to B.D.E but the person told me to contact directly to M.D.I requested several times that you are my reporting authority and is is not
fair to disturb M.D regaeding this small issue.Unwillingly I sant the mail
to MD in details cc to B.D.E.and very next morning B.D.E shouted on me as I sent the mail in details. After that immediately I contacted to MD and
asked to me to reach at office he would talk everyone on con call. But when I reached at office B D E told me not to continue my duty as per order from H.O.Unfortunately I tried but couldn't contact immediate to M.D.I just left the office and after few times I only could contact M.D and
he told me no instruction has been given by him and asked me he would contact me later. The next day I couldn't get any response from MD and after that next day I rcvd the mail which is TERMINATION LETTER,on which the reason mentioned are neglegency to job,not followed the instruction of immediate BOSS. This is the picture
So my friends my question is whether co. could legally issue TERMINATION LETTER before issuing APPOINTMENT LETTER.As per my knowledge there are only two cause co. can TERMINATE anybody at any
stage any condition if the submitted documents by anybody get forged and if in absconding case otherwise without issuing showcause or warning
letter co. cann't terminate anybody.

Subrata, I think your company is not a corporate but a prop.ship company where the MD/Boss takes decision as per their whims & fancies. Better look elsewhere. All the best. Pon

Hello ssubrata.sarkar,
Don't you think that you could have saved yourself & the members a lot of trouble had you mentioned all these details yesterday itself?
Coming to the factual situation, Pon is right. Just forget that you worked here for 15 days & look elsewhere.
Looking @ it in another way, MAYBE THEY DID WHAT YOU SHOULD HAVE DONE--breaking the Link? So maybe, in a way, you ought to thank them :-)
And learn from this experience: "Look before you Leap". Next time, better get to know more about the Company before you commit yourself....leave alone even Joining them.
All the Best.

My friend,
Reading your predicament in such detail, I wholeheartedly second those who have replied prior to me!
Get The Hell Out Of There! That's it! Don't even think of an alternative.
I agree with the others that God has made them do what you should have done in the first place.
Forget about the technicalities of whether or not they can issue the letter, or what the sequence of letters should be.
Consider the Termination Letter as a direct gift from God. Take it with both hands and make sure you don't drop it.
And, as far as your career is concerned, this episode never happened.
I wish you all the Luck in your future endeavours.

It is possible that the Md is bring mislead.
Youmshould try to talk once more to him to clarify what happened and explain that you have not neglected your job. It's a small world after all and it makes little sense to let someone carry a negative image of you and convey it to others at a later day.
Ofcoure, staying back in the job is not a good idea, specially when you have made an enemy of your immediate boss. You need to find another jib immediately.
