Hi,
If the boss has not paid the salary for the month of January till fifteenth of February, and the employee resigns on February 16th, whether he is eligible to get the salary of January month, where the notice of 30 days is compulsory.
Pls guide me with your valuable suggestion.

Yes, you can get 15 days salary by negotiating your 30 days as notice period, and leave the company immediately. If, the company is ready to relieve you
Or
Yes, you are eligible to get your Jan salary, and you can start serving your notice period effective from 16th Feb.
During the resignation period -
1. Its best practices not to take leave, unless it’s an unavoidable.
2. Knowledge transfer to be done 100%
3. Cooperate with the management and get a smooth reliving.
4. Also if possible you can help by referring for your replacement.
5. Duly complete your exit formality.

Dear Bhagya,
January salary, Yes. Reg. notice period, it depends on the terms of apptt. If the apptt. order says 30 days notice on either side then you have to serve the notice period. Alternatively if U have leave in credit U can surrender 30 days and get relieved. Now it is May, we are discussing about Feb. nothing happened till today ? How ?
