I am representing about 2000 employees of Indian Drugs & Pharmaceuticals Ltd; (IDPL) a govt. of India Enterprise. Every employee of IDPL is compelled to opt for Voluntary Retirement Scheme (VRS) under the threat of retrenchment and for ultimate closure of IDPL. Most of the employees releived during the year 2003 (retaing 300 out of 7000 to complete the process of closure) with a skimpy amount calculated on 1988-90 wages in their age group of 40-50. This all was done due to good bad policies of our democratic setup.
Do you know that during the year 1992 Mr. Man Mohan Singh was Finance Minister in Narsimha Rao Government. As FM he managed to convert SOCIALIST ECONOMIC SYSTEM to CAPITALIST ECONOMIC SYSTEM to improve Indian economy by declaring most of the PSU's (established by the Ist PM of India for Social needs) as sick Industrial organisations. Not only Mr. Singh as FM of India succeeded in ruining/destroying Narsimha Rao's political career he suceeded in destroying lives of thousands of innocent employees and their dependent family members also.
After failure of BJP government, Mr. Singh again hold the power and as PM of India he showed interest in social security and social needs and again stressed to convert CAPITALIST ECONOMIC SYSTEM to SOCIALIST ECONOMIC SYSTEM just to fool the innocent AAM AADMI. He started deputing his good book bureaucrats in these dead and inoperative PSU's during the year 2006 to digest assets of these PSU's.
In this way his team started violating every provision in DPE guidelines as well in VRS by deputing manpower in these inoperative PSU's' IDPL is the only name in Indian history where every employee is relieved in the name of ultimate closure, whereas closure never took placed but after a brake of three years Mr. Singh Government managed to digested Rs 150 crores from 2006-09 by deputing an NGO named as CONSUMER INDIA headed by Ms Jayashree Gupta as C&MD of IDPL alongwith her retired staff from various central ministries above the age group of 60.
These retired employees are enjoying every facility apart from monthly pension from Central government and enjoying revised pay benifits from IDPL.
When we aproached concerned ministry and IDPL management for this descrimination they refused to entertain our request. Finally we approached the Court of Law for our justified social and constitutional rights as per rules and guidelines issued from time to time by the concerned departments. As we are eligible to claim wage difference after implementation of wage revisions and reinstatement in service as there is a provision in DPE guidelines that there will bo no recruitment arising out of VRS and difference will be paid subsequent to VRS.
Whether we will get our justified constitutional rights under the yoke of BUREAUCRATIC DEMOCRATS of Indian Republic

Whether an employee is eligible for wage difference for a period untill his retirement date if retired before wage revisions, as revisions effect from 1990 and he retired during the year 2003.
