Dear all , I need to know if an employee resigns on an urgent basis without serving the complete notice period, what will be his dues( if at all).
Suppose the duration of notice period for a company is one month, and an employee put resignation on 13th of the month stating his resignation on 20th of the month. Should the employee be paid for 20 days or should he pay back to company for not serving the notice period for 23 days???

It depends on the company's policy regarding notice period and buying of notice period. If the company thinks that he is to be relived waiving his notice period it will not press for notice period salary and settles him by paying salary for the days worked. On the other hand, if the company is very strict regarding notice, then it will not pay the days worked but will collect amount from the employee the remaining days' salary. It is often noticed that the employee on notice period will remain in office till the close of notice but will never be productive. If so, what is the logic in not relieving him on the day he wanted to leave?

Madhu TK is right.
Also, depending on the nature of job [if it's a critical or confidential one where his continued presence could hurt the company's interests] of the employee who resigned, the Notice period may be waived by the company.
Also sometimes his/her presence may be counter-productive [other employees may be adversely effected]--in such cases too the employee may be relieved earlier.
Most often, such decisions are taken on a case-to-case basis.
