Hi All Seniors,
If I am working in a XYZ private limited marketing company with 30 employees without registration in EPF and ESI. Everyone is withdrawing 20K per month in cash or cheque . So is it necessary to be registered into EPF and ESI. Could they withdraw their salary without any deduction? Is there any way to out of EPF & ESI?

Dear vxlgaurav
You will have to get registration under PF Act and will have to submit Form No. 11 in respect of the employees opting for not to become member of the EPF scheme. If there is any employee who was a member of PF in earlier co. then such employee will have to be covered under the act.

If the basic+DA of all employees are above Rs. 6500 p.m, there is no statutory obligation to register with PF. Even though some of the employees were covered under EPF in the previous employment, it will not be applicable for the present employment.

It is correct. Once you crossed Rs.15000 per month gross, automatically you will come out ESI, but continue to deduct ESI till the contribution period over
