Can i get any maternity leave payment from my company

Dear,
You have taken form ESIC then how can you get from the Company.
According to the company will you can have some monetary benefit but not legally way.
During your absence the company show you like on maternity leave.
Leave payment i think you have taken form the ESIC then their is no provision to get the benefit from the employer but on their will u can have but this also beyond the law.
Finally you can have one side benefit not from the employer side.

This is clarify that when an woman employee is getting benefit under the ESI Act, 1948 then in that case she can not claim any benefit under the Maternity Benefit Act, 1961. So the management is not to provide any benefit in such like cases under the M B Act, 1961.For more details you may also go through section 2(2) of the Maternity Benefit Act, 1961.
