Dear Seniors,
I am in manufacturing industry which is in Bakery and patisserie products. They have 150+ employees.
Here, they have no HR department I have to start up.
Like initially I interacted with each one of them prepare Job Descriptions. Right now studying each section identifying their problems and discussing with top mgmt.
Here they have 365 days working, no holiday given. I convinced mgmt to give atleast 2 holidays in a month.
Workers here are given wages of 3200/- per month , provided they work 12+ hours till the demand gets over and no holiday. I think this will not work out here.
What are your views on it ?
I want your guidance which will help me out.
Kindly do the needful.

What is your background? Are you setting up the HR Dept at the bakery? Where is the bakery situated? The minimum pay could from vary from State to State, as per the Min. Wages Act in force. Are you aware of the Act? If you do not succeed to find that after searching the web using Google, I will give you the reference. There is more joy in finding it for yourself.

I am no HR expert. Also I am based in UK. However, I am sure the company could be taken to the court to ensure they conform to the minimum wages act. I am sure if you contact Mr. Madhu.T.K, Board Moderator at CiteHr, he will guide you better.

You may set up the HR department in your company but what is the use of HR department which couldn't save the workers from exploitation from the capitalists.
You said you know the labour law then where you have read about 12+ hour working??
I think the wages also lesser than the minimum wages act??
HR department is not only colourful poster at working place but to make the workplace colourful.....

I presume that your factory is not a new one. As such the factory has been violating Factories Act and Labour laws which are applicable to your establishment since its formation. Since it is your responsibility to bring the entire system in a process, you have to start from lesson one. Certainly, it is good for you. You may start with legal compliances, ie, filing of returns required under the Factories Act, Industrial Establishments (National and Festival Holidays) Act (which is a state Act) and so on.
If the situation is like this, I also presume that your establishment is not covered by EPF and ESI. The matter of payment of minimum rates of wages is a serious issue. Though Minimum Wages Act is a central Act the minimum wages in respect of your industry in your state is fixed by your state government. You can get a copy of the latest minimum wages to be given to various categories of employees in your industry from the Labour Department.
Being an employee who has substantial control over the establishment, you should not go parallel and get it done through the intervention of enforcing authorities but convince the management and then get your establishment covered by various Acts. You can very well advise your management about the consequences of non payment of minimum wages, non implementation of social security schemes like EPF and ESI and non adherence to the hours of work provided in the Factories Act. You may even warn them that non compliance of many laws are cognizable offence for which the employer can be prosecuted. But I know many know this but seldom care either due to their relation with the Law enforcing authorities or due to their power of money.
It may not happen all of a sudden but it may take time; still you can do a lot and that would be beneficial to the workers and by doing so, the workers will start feeling the presence of HR in their establishment. That is the real HR.
Therefore, trace the Factory licence, returns filed during the last years/ half years. Collect information about minimum wages applicable to bakery workers in your area. If not covered by EPF and ESI (if situated in an implemented area) initiate coverage. Fix holidays and off days and ensure that no employee work for more than six days without any off day.
