Dear All,
Ours is a bio tech company, we have never been covered under ESI PERVIOUSLYsince the slab has changed i think the time has come for us to enroll in ESI and we have a total strength oF 120 employees in that 17 employee's gross salary is less than 15000. Now please guide me whether is it mandatory to cover our employees under ESI??? if yes what the procedure. We are based in chennai. Please guide me...............

As per the new act of ESIC, the limit has been increased from 10,000 to 15,000 which is effective from may 2010. So now its mandatory to cover the emplyee's below Salary of 15,000 under ESIC. Please check the new notifications on the ESIC website.

As per the present ESI rules employee who earns 15000 per month also cover under this act. So you need apply ESI for all employees in your organization.

Hi Prema,
If employees are working 10 or more in the company the ESIC is applicable to enroll the registration. So go through the tamilnadu ESIC act. they will guide all about ESIC registration and all.

If ESI is deducted from the salary more than 10000 (Gross) before May 2010, will that be a legal deduction ?
My gross salary was more than 10,000 and the company deducted ESI from June 2009 till June 2010.

Hi Prema,
ESIC deduction is a statutory compliance. So it is mandatory to deduct ESIC for the employees whose monthly gross salary is 15k or below.
Its better if you go through the ESI act.

Dear Prema
First please mention whether any manufacturing activity (factory) is being carried out in your company, if so, then you are required to have a minimum qualifying strength of 10 for coverage under ESI.
Suppose, your co. doesn't manufacture but only does service (establishment) then your minimum qualifying threshold would be 20.
From 1/6/10 the ESI Act has been amended, hence no need to worry about the number of employees above or below 15000. Post amendment only the strength matters and not the wages. Since you have 120 employees you ur co is coverable w.e.f.1/6/10 irrespective of the salaries paid to your emplyees

sir, yes it is mandatory now to enroll for ESI and EPF in one challan, ESI limit is now increased to 15,000 Rs., hence all employees from 0 to 15000 are covered by ESI, for applying, pl. contact Regional ESI office or get the form downliaded from the net,,www.esi.nic.in

FIRST please check out the area in which your company is situated is "NOTIFIED" by appropriate government as the "ESI COVERAGE AREA", if so you are require to comtribute and deduct the employees contributions from the eligible employee and to subscribe the same in time to avoid any penal charges.

I have been working with Tribhuvandas Foundation for last 8 years. Tribhuvandas Foundation is a voluntary organization working since more than three decades to provide human health care in twin milk districts of Kheda and Anand in Central Gujarat. Our Trust registered under Public trust act 1950.
The Foundation has been recognized as a reputed health organization by Govt. of India and many other agencies.
I would like to cover my employees under ESIC. We have 119 employees at present. Please guide me whether we are cover our employees under ESI??? if yes what the procedure.
