Employee Separation Agreement

This Agreement, made an entered into between _________________________, employee of _________________________, (hereinafter referred to as "Employee"), and _______________, (hereinafter referred to as "Company");

Winesseth:

A. Employee is employed at Company.

B. Employee is willing to tender his voluntary resignation from employment with Company and to waive all rights with respect to any matter connected with his employment with Company.

C. Company is willing to accept such resignation, and will give additional compensation to Employee as set forth below.

Now, Therefore, in consideration of the mutual covenants of the parties hereto, It is a Agreed:

1. Employee herewith voluntarily resigns from employment at Company effective __________, 20_____.

2. Employee expressly waives any and all rights with respect to all matters relating to or connected with his employment at Company which he now has or hereafter may acquire and agrees to not initiate any action, legal, or otherwise, against Company or any successor or assign or any other employee, agent or representative of Company.

3. Company agrees not to contest or object to any claim for unemployment compensation benefits by Employee based on his employment with Company so long as Employee is out of work and otherwise eligible for such unemployment compensation benefits within the meaning of the ________________________ Statutes.

4. Company agrees to pay to Employee _______________, and Employee hereby acknowledges receipt of same.

5. Relative to any reference for future employment, Company agrees to respond that Employee’s reason for leaving employment with Company was due to his voluntary resignation.
