Dear All,
Can someone help me regarding the eligibility for availment of Maternity leave?
What should be the minimum service period after which an employee can avail of the maternity benefit?
How long can it be extended - without pay, keeping the lien on the employment?
Thanks & regards

Dear HVK,
Pl find the condition for availing maternity benefit :
(a) An employee should have worked for minimum period of 80 days including leaves in general or gazated holidays in preceeding 12 months.
Under Sec. 9 of the act there is a provision of extension of leave for 30 days (other than 84 days which is granted in general ) together with full benefit for the illness or complications arising out of pregnancy .
However there is no as such provision under the act to allow leave for more than this,But if complication persists than the empoyler should ideally grant leave that also but employer is not liable to make any payment as a benefit for more than that.
