My organization comes under shops & Establishment act. And a few days back a Labor Inspector comes and asking for the Standing orders certified from the Labor Department. As I do not know much about it because as far as my knowledge after the starting of the any organization, in next six months the company has to make the Standing order and get it certified. But the org. is running from last three years and it’s not having any standing order till now. And I have joined this a few months back so I am not having the clear idea about it.
This is a hotel where we have our own corporate office but they told me to make it by urself for your unit. I request you all to please give me some idea how to go about for this.

Dear DSP, Till the time Standing Order is not Certified by LC, then the model standing order is applicable , u dont have to be get it certified if there is no union of workers AGP

In maharashtra establishment having more than 100 employees has to certify its standing orders by Deputy Labour Commissioner.
Please ckeck out with your nearest labour office for the same.

In Maharashtra whose consent will be taken for hearing as second party, no matter how much strength u have for the perpose of Certified standing order AGP

Thanks seniors for your help and support. We are more than hundred employees and i had consult with the Labour consultant and he is helping me to make it one and even to certify it from labour department.And once i will make it the by the guidelines given i will definately share it with all so that anybody cannot get confused by it like me.

donot give worng advise,it has to be be certified if strength is more than 100.if union is not there than inspector will visit to your establishment elect workers representative for this purpose.

Mine is company of Gujarat having more than 2500 employees as sales promotion employees through out the country. My question is can the company transfer any SPE from one state to another without any certified standing order as the case is in labour court that the company does not have any certified standing order as given in writing by the labour department.
