I have one query.
I am an employee in one company say A since last 3 yrs
I am deported to client place & working there say B
There is a service level agreement between A & B.
That agreement is now going to over. Neither A nor B wants to extend it.
At this recession time, A is advising to join B, & B is also offering me to join.
I am going to join B. Now what ll happen to my Gratuity with A for 3yrs.
I know to get that money I should complete 5yrs with A, but neither intensionally I am not leaving A nor I am being laid off by A. So
Is it legal to demand my gratuity money with company A?
What is the probability of getting that money?

dear legally you are not entitle to get gratuity.minimum 5 years of service is required ,let it be any cause of your leaving the organisation. tks j s malik

One has to serve organization for minimum 5 years continuously to be eligible for gratuity. I agree with Mr. Malik. You are not eligible for gratuity. As you are on the rolls of a different company technically.

Dear Satya,
As per your queries, I agree with Mr. Mallik, I mean to say that if employee is completed 5 yrs in same org. then he/she would be entitled for gratuity hence you are not eligible for the same.

Thank you all for the information. Again I am not only one, we have a team of 12. By any chance will company A consider refunding our gratuity ?? !!:sad: for the sake of 12 employees !!
