Hi All,

We are a ITES company and are registered under Punjab Shops & Establishment Act. As the Act says about total leaves/holidays that one has to provide for in a year
  • Six Holidays - three days 15th Aug, 26th Jan & 2nd Oct and three other
  • One day Earned Leave for every 20 days worked i.e. total 18.25 leaves
  • Seven days Casual Leaves & Seven days Sick Leaves
We in our organisation give 11 Holidays, 14 Earned leaves, 7 Casual Leaves and 7 Sick Leaves.

We want to know
  1. Whether we can give just one type of leave instead of PL,SL and CL? Will it be a contravention to any law? We would continue with our Holidays.
  2. What should be the policy of leave sanction / availment in such a scenario i.e. any specific capping for maximum no. of leaves to be taken at one time, what about unplanned / non santioned leaves taken due to emergency situations, what documentation can we ask for granting / sanctioning long leaves either before or after the employee's leave period.
  3. What about the balance leaves which are not availed by employee at the end of year i.e. carry forward or encashment. How much?
  4. Can we have few employees working on days like 15th August, 26th Jan due to business requirements- we would definately pay the OT. Does any pre-authorization is required in such cases?
I will be thankful and welcome feedbacks / guidance / suggestions for this.

hi saurabh,
ans. for 1 u cann't club all the leave because pl is encashable and accoumulated and other laps end of the year.
2. u have to make rules for the same what is going to in similar industries or read the bar act to the same,
3 ans is given in no 1.
4 yes pre authourisation is require in that case

Thanks Mr. Bakshi, Your guidance is of immense help.
As regards to query no. 2 - The act does say that the leaves have to applied prior (scheduled) and then sanctioned and if not sanctioned then a written explanation must be given to employee. If such leave is applied again then it has be allowed. Well, Sick Leaves are never planned... so we just wanted to know how does people grant sick leaves do prevent its misuse as we all know that getting revelant docs like Doctor's certificate is how difficult (???) to get, moreover, as we are into a competitive enviornment where TAT is so important sometimes too many people taking Sick Leaves on a single day effects the work! If any sugesstions can be given for this by the ones who have faced similar problems, It will be quite helpful.
Also we will be obliged to know that from where we get these types of Pre-authorization (query no. 4) for working on a Public Holiday, What is the procedure and What are the implications if few employees work on those days due to business rerquirements (though they are paid OT).
