it is not a compulsory to give a leave on that day but you have to give marginal time to cast their vote because you can not deny the rights of voting of any individual.

It is absolutely necessary to give leave to all your employees for the complete day as notice to this effect is published by the Labour Dept in all important national newspapers before elections.

Hi all,
I accept the point of Rajinder but i have a doubt if we are giving leave on the election day whether we can compensate that leave in some other day? for example in Tamilnadu 13th May 09 is an election day and we are planning to give leave to our employees whether its possible to compensate this leave on Sunday (17.05.09). Please suggest.

We are not supposed to go for COMPENSATORY.
I have checked with some expert.
More over, If we are going for COMPENSATORY Towards election leave, we(Company) have to pay double wages for the employee.

Please find the amendment of Indian constitution for Poll day.
There is an amendment in the Representation of People Act 1951, Sec 135-B was inserted and it states that effective 1st August 1996 " Every person employed in any business, trade, industrial undertaking or any other establishment and entitled to vote at an election to the House of People ot the Legislative Assembly of a State shall And Parliament, on the day of poll, be granted a holiday. Therefore it is mandatory on the part of the employer to grant paid holiday to employees who are entitled to vote for election.
Where as in india we dont follow Constitution, It is upto the management decision.
