We are also to consider the D A along with Basic while calculating the amount of gratuity. Plz go through the definition of wages under the PG Act,1972.

"As Gratuity is applicable to those employee who have completed continuous 5 or more year services. They should worked 240 days in every year. Gratuity is payable 15 days per every working years."

Please clarify me
If any employee has worked in a organisation for 8 years.
For the first and second year he has worked for more than 240 days.
For the Third year he has worked for less than 240 days.
and for rest of the five CONTINUOUS YEARS he has worked for more than 240.
Then please clarify me whether gratuity is payable? and if so for what many years i.e. for 5 years or for 7 years.

In you case/query, the employee have worked for 8 years continuously. He is eligible for payment of gratuity payment leaving behind only one year in which he have not put in 240 days working for entitlement for gratuity for that particular year. This can not be considered as break in service. Therefore this employee will be entitled for 7 years gratuity.
