If any person accepts the offer letter by signing a duplicate copy and does not join the organisation what action can be taken against him?

Hello friend,
NO ACTION can be taken. What we need to do from HR is to have alternate opetion candidates available so that we can close the position fast.
If the candidate has come from a consultant - he may be able to provide alternate candidates for consideration to reduce the time to recruit.

Dear Shail,
You cannot take any action in this case. Merely by signing the appointment letter does not make the candidate an employee of the organisation. For any action to be initaited, there has to be first an employer - employee relationship to exist. In such case, since the candidates has just accepted the Appointment Letter and not joined the organisation, no action can be initaited against the candidate. You can, at the most, blacklist that candidate for all future appointment in your company or group companies.

Offer letter is just a formal letter intimating that the candidate can join on the specified date.
Even if the candidate sign the duplicate copy of offer letter, you cannot take any legal action because here the candidate is not an employee of the organisation until he joins.
