I hereby attaching the latest amendment in PF state that EPF Act Applicable to foreign employee on 10.10.2008. So Can anybody send me the procedure, like how to enroll them and how much we have to deduct from there salary, (from 6500 12% - 780 or some other)

Dear Shan,
As per the PF act employee earning more than 6500/- as basic, do not fall under the PF act. Please clarify if my understanding is right. As there are 25 employees working in our organisation but we do not have PF as a part of our salary.
Would be grateful if you could clarify this.

Some points on Expat PF
1. Rs 6500 limit is not applicable for international worker.
2. This is applicable from 1st Nov 08
3. Consolidated return ( IW-1 ) to be filed.
4. There are some restrictions for withdrawal
( clarifications obtained from P F Commissioner B'lore )

Dear friend,
We have checked up with the regional provident fund commissioner and was informed that in case an international worker (foreign national working in India) has social security number abroad and he is also contributing towards social security or his employer taking care of social security in abroad, then the issue of PF applicability in India need not be carried out.Of course his basic salary should be > INR 6500/- and can be taken as an excluded employee.

Kindly provide some information to my query on PF withdrawl,
One of my colleague is in servie from last 5+ years, he want to withdraw some part of amount accumulated in his PF account without quiting the company, So kindly let me know about the provisions of PF Law in relation to my query,
as per my knowledge 4 years service is must for this kind of withdrawl ,
so kindly let me know the clear picture.

Dear Mr Ganesh,
Internation worker to be excluded from PF, just social security number is not sufficient. India and that country should have entered Social Security agreement. Presently India has such agreement with only three countries. ( see definition of excluded employee.. )

Dear Member,
Complete withdrawl is only possible when employee has left or changed the services. While remaining in services we can only apply for advance by using Form No. 31
For PF withdrawl : Use Form No.19
For Pension amount withdrawl : Use form No. 10C (if service is more than six months & less than 10years)
Both the forms to be deposited the Regional/Sub-regional PF office after getting it attested from Employer.
