So, tell me :
In the example you have sighted, if the company has not deducted the amount from the salary because the number has not been allotted, how does that help the employee who died or his / her family ?
And the employee has already died. But the employer is still liable to pay the amount to the PF department. How exactly will he pay it ? From whom is he going to deduct the amount ? From his full and final ?

You are right in the situation you have referred. . Hence, the correct situation, get the number as early as possible and then only deduct, since it has bearing benefit. Except new organisations, all others, mostly, possess number and hence for the benefit of the contributor, they should allot the number and so on so forth. Further, my presentation is collection done from the worker, number not allotted and in the mean time died, then what is the situation ?

In my opinion, if the estt. had applied for code number, soon on coming into the folds under the Act, had deposited the dues in time and had submitted the returns by quoting the Code number as Applied For, if any death takes place, RPFC is bound to grant benefits after allotting the code number as delay is of the Deptt and not on the part of employer. However , RPFC will get the matter relating to death from vigilance point of view as to if genuinity of the claim.

Dear Chandok Saheb,
Unfortunately most of EPF official (any govt official) do not settle the issues accepting the fact that the delay was in the part of the EPF dept. They simply follow the provisions of the Act in black and white.
I personally know a case where the EPF dept has not settled the pension of a female employee till date who retired in 2009 though all relevant documents where submitted with the concerned EPF office in April 2009. Reason is as usual record/application not available with EPF office ...misplaced/lost during the digitization of data. The application has been submitted thrice.
Matters are settle judiciously only when the party approaches the legal forum.
I would simply say EPF dept is working in a horrible way.

Dear Kprasoon ji,
You might have experienced difficulties long time back but now the position has changed because of the advanced computerisation in almost all the offices of EPFO, even one can file complaints / grievances online. There seems to be some problem relating to claims of EPS but I must say that services have been improved leaving aside cases of assessment of dues. But EPFO is bound to do the things in stipulated times failing which their services are bound to be deficient as for as Consumer Protection Act 1986 is concerned

Dear Chandok Saheb,
I agree that services are in process to be improved but the attitude of the EPF employees also needs to be changed. They know they cannot be punished individually for their intentional wrongs, so they are careless. Still the fact remains that there no accountability as such.
How many people can approach the Consumer Forum ? How many people can file an application under RTI? Not even .001%

PF authorities feel that everything is online. Nothing for them to work. Practically it is most unkind department. Poor workers are the worst sufferers. There are none to work for uneducated, less educated PF contributors. Establishments are also not keen to help who left the organisation either on retirement or otherwise.

I am in Real estate broking firm based in Noida, U.P where the confirmed employees are 15-20 in which 4-5 are in backend & rest are in sales department who can resign anytime, My Query is their Basic+DA is more then 6500 and we have never applied for any PF Code or deducted any amount from employees.
Let me know the format where employees can avoid PF contribution as per their wish.

Hello,
If the number of back end as well as front end is 20 or more, you need to take PF number There may not be even a single employee with less than 15000 pm salary, even then you need PF number and submit statement of Nil. No avoidance..
