One simple fact if one has not signed his appointment letter he or she is not joining the company and even not adhering to the norms of the company. He or she is dis selected and hence no joining or release letter has any value.

Employer can't ask for notice period or payment if sign agreement is not in place.
lot of employer doing this type activity for avoiding the statutory liabilities, but some time employer comes in range, same as above case.
What is the base for asking the notice period without agreement? it is clear negligence of HR .

In most of the companies, employer will ask for mail confirmation on accepting the offer. And if there are proofs that employee has worked and took some of the organisation things. Then he will be in trouble as per legal.
If doesn't signed doesn't mean that there are no legal actions take place, but it depends on the data or details that the employee has taken away from the company.
If employee doesn't signed and doesn't even joined the company may leave the associate as not joined case. But if he worked company may issue absconding letter that may give a negative feedback to associate.
