Accordind to Gratuity Act Employee must Completed 5 years to get gratuity Amount or as wish of management you can entitle gratutity must period completed 4years 8 months, its states that you are not elligible for gratuity.

Gratuity is payble only as per Gratuity Act even though the amount shown in the CTC. Therefore 'should get'; stand is just argumental but not Legal.
Retrenchment compensation can be claimed as per legal provisions under ID act if it is 'Closer' as approved by the Govt under the legal provisions.

Dear Prashantji,
The Gratuity which is included our CTC is difference than the Gratuity which will applicable as per act. IF the gratuity is the part of salary, the employer has to pay while leaving/closure of the unit. Am I right? can you reply me now, I am on line please.
