Whether the employees who get professional fee per month and are on roll contract employees be eligible to gratuity ?
No: Since he is getting professional fee not salary he may not be eligible for gratuity

Dear Alphonse,
If the employee is exclusively working for a single organization and organization has a direct supervision on his work/job, this establishes employer-employee relationship. Organization is already making direct payment. Hence eligible for gratuity.

One employee continues in service even after retirement age.
say he retired on 31-3-2010.
How do we calculate the gratuity payable.
Do we pay
- as per pay & no. of years service as on 31-3-10 + interest till date
(Pl advise intt rate applicable, & any judgement / rule / section in favour of this choice) - or -
- as per pay & no. of years as of today ! ( This figure will be higher than the earlier option)
