Dear Mr. Harikrishnan,

With respect to Mr.Kamal Prasoon Sinha's querry, If employee is not covered under ID Act & approached Civil Suit for damage. How this Damage can be calculated.

For Example:

Employee is now 41 & it's very difficult to get another job easily that too as per high current CTC of 16.55Lakh.

Now he filed case in Civil Court & demand for reinstate as per advice of local lawyer.

Now going through different thread of Termination discussion in this Forum it has been learned that Civil Court cannot order Reinstate & only Damage Charge can be claimed.

So please suggest what could be Damage Charges looking at Age, Seniority, & Job Opportunity?

Basic Salary/Month - Rs.52220, HRA-Rs.26110, Supplementary Allowance - Rs.26110, Conveyance Allowance- Rs.800, Children Edu-Rs.200,

Total Salary per Month Rs. 105440 plus LTA-Rs.52220, Medical-Rs.15000.

Worked in this organisation since Dec 2011 till 7th Mar 2014.
