Hi all,
I work for a company from the past 2 and half years. When I have joined, I have signed for a notice period of one month in my agreement. recently the management has circulated a mail, informing that the notice period policy has been changed from 1 month to 2 months. can a company unilaterally change such policies. Can it force the employees to serve the 2 months notice strictly.
please give your opinion

Unilaterally they can not change
But they would have taken a signature in the Copy of the circular
If they have not taken the consent signature, legally it is not valid
But noone will go to court for such cases unless the Notice Period is changed to one year!!

The Company cannot change the notice period unilaterally.
In your appointment letter you will observe that either party can severe relationship by serving one month's notice.
If the Company change their policy to 2 month's notice then either party should have the benifit.
From your posting it appears that the Company Circular only informed the employees that the Notice Period is changed to 2 months. However the same is legally not valid.
But who is challenging such trifle matter in the Court of Law??

Guys, Thanx for your replies.
They have not taken my signature on the circular. Now they are telling that they will not issue the relieving documents unless I serve two months notice. as I told you, I have served one month 3 days of notice already. Is there any way to get my relieving documents. please suggest.

Tact is the only solution.
Handle it with tact
Handle with care
Top Management actually really may not bother about these. In fact some top managements relieve them once they submit resignation.
Normally it is your boss who decides. HR will talk about rules but as long as you pay the balance notice pay they can not talk much
Approach tactfully. You will succeed.
