Hello Everyone,

I would like to know the name of the clause which states that " an employee is prohibited from working for a client for the next few years"
Apparently, it's pretty common in India, its there in Flipkart as well.


Please help me with this, also do attach some sample contracts if you can which state this clause.

Hi,

It is non-poaching Agreement to be entered with the Client which will restrict client hiring your employees.

For employees Non disclosure Agreement can be obtained either at the time of joining or on date of exit which restricts employee sharing trade secrets/ joining competitor company for stipulated time frame. However the legal validity of NDA in India is a question mark !
