Dear All, If any worker drawing wages Rs.22000/- per month, every month due to sickness avail leave without pay for 2 to 3 days. considering the circumstances, he is willingly interested in ESIC coverage.
Shall we remit contributions? as a voluntary contribution? is he eligible for Medical, Sickness, extended sickness, Enhance Sickness, Super Specialty for IP & Family, Temporary disablement, or permanent disablement benefits?

Hi,

If the Gross salary of the employee is greater than Rs.21,000/- then ESI deduction not required. Based on employee's choice he can't enroll into ESI.

Also please note that if the wage of an employee exceeds the wage limit of Rs. 21,000 after April or October for the respective contribution periods, then the employee continues to be an employee till the end of that contribution period.

Wages can be adjusted to accomodate the employee to get the esic entitlement.
However there is min period of contribution specified for availing benefits.
This is however subject to consent of emplpyee and employer.
